CONTRACT LAW DISPUTES
All "Contract Law" disputes require a review of the basic elements of contract formation, offer, acceptance, and what is to be paid known as consideration. To help in the analysis of a dispute you need to answer questions like:
- What was the offer?
- When you accepted the offer or contract, what terms did you agree to?
- When were you suppose to do them?
- What did the other party fail to do?
- What are the terms of payment?
- Is the contract written or is it an oral agreement, or a combination?
- What kind of problem are you trying to solve?
- When did the problem first appear?
- What kind of documentation (letters, e-mails, faxes, invoices) tells the story to answer these questions and where is the documentation?
- What do you think you have the right to do now and what do you want to do?
- How can you enforce your rights?
- What kind of dispute resolution clauses are in the contract? For example, is it arbitration, or litigation? Does it include mediation?
- Who pays for the costs and attorney fees in the dispute? Doe the loser pay?
- What law applies and where will the dispute be decided?
CONSTRUCTION LAW
Prior to his legal career, Attorney Berry was CEO of a construction and manufacturing company which participated in the construction of Low, Medium and High-Rise (a/ka Monumental) construction projects. In 1987 his company was ranked sixth best in the U.S. by Engineering News Record magazine. As a result of this hands on experience, Mr. Berry understands the construction process such as owner relations, design, specifications, preliminary budgeting, schematic drawings, bid assembly, estimates, award, execution, subcontract and supplier management, billing, retainage, lien actions, punch list, warranty and post construction defect claims.
